Warranties

You warrant that:

-you are of at least 18 years of age and have legal capacity to use this site;
-you are financially responsible for all users of this site by you;
-any information you supply via our website will be accurate and will not be misleading or deceptive.
-you warrant that you have suitable health and travel insurance.

Health

You acknowledge that your participation in any of the tours offered by this website is solely at your own risk and that you are responsible for assessing your level of fitness to the intent that we will not be liable for any personal injury suffered by you as a result of participating in relation to any tour offered by this website.

Personal injury

We will not be liable for any personal injury that you suffer as a result of any tour packages that you participate in as offered by this website. The Accident Compensation Corporation (www.acc.co.nz) administers New Zealand's accident compensation scheme which provides personal injury cover for all New Zealand citizens, residents, and temporary visitors to New Zealand. As a result, people do not have a right in New Zealand to sue for personal injury other than exemplary damages.

Payment terms

All prices and transactions processed on this website are deemed to be effected in New Zealand and in New Zealand dollars only and, unless otherwise stated, include GST. For online orders we are only able to accept payment by Mastercard and Visa. Should you wish to pay by any other method please either phone, fax or email us. If payment is made using a credit card issued outside of New Zealand, any currency conversion will be done according to the terms and conditions of the card. There may be currency conversion fees charged by your card issuer.

Cancellation policy

If you need to change the date of your tour you may do so provided that you give us at least 30 days' notice and pay us an administration fee of NZ$100.

If you fail to provide us with such notice then we are under no obligation to change the date of your original booking or provide you with a refund.

If you cancel your tour booking by giving us more than 30 days' notice then we shall provide you with a refund of your payment subject to a deduction of a NZ$100 administration fee and any applicable bank reversing charges.

We will be under no other obligation to provide you with a refund except on the basis stated above.

General

These terms and conditions are governed and construed in accordance with New Zealand law and you accept the exclusive jurisdiction of the New Zealand courts. Terms and Conditions of Sale of Goods

Returns

No goods are returnable unless defective in workmanship or material. Liability will not be accepted unless goods are returned to Club Fish in a clean state.

Exchanges

Club Fish will accept the return of non-defective goods for exchange (for example a size change) for goods of the same value, in its sole discretion, subject to receiving the goods back within 7 days after delivery, in original condition with any tags attached.

Delivery

Time of delivery cannot be guaranteed because delivery can be subject to delays caused by factors beyond our control such as strikes, breakdowns, raw material delays, etc. Club Fish gives an estimated time of delivery of 10 working days for all European, North American, Canadian and Asian countries and 5 working days within New Zealand.

Loss

Club Fish will not accept responsibility for loss of damage arising from delay, or failure of delivery.

Special Freight Requests

Special or urgent (such as overnight delivery within New Zealand) requests will incur an additional charge to the customer.

Ownership of Goods

Ownership of any goods sold and/or delivered by Club Fish is retained by Club Fish until payment is made in full for goods.

Placing an order is deemed acceptance of these terms and conditions.
